BREXIT: LEGAL REQUIREMENT FOR THE SHARING OF MEMBERS’ DATA

We are required by the law of Luxembourg to obtain Members’ explicit approval to waive the provisions of Article 300 in relation to the sharing of the data held by The Britannia Steam Ship Insurance Association Europe (Britannia Europe) with the Managers (currently Tindall Riley & Co. Limited, Tindall Riley (Britannia) Limited and, after 20 February 2021, Tindall Riley Europe Sàrl). This requirement arises from the re-domiciliation to Luxembourg of The Britannia Steam Ship Insurance Association Limited (Britannia) through the Part VII Transfer of the entire undertaking of Britannia to Britannia Europe which is scheduled to take effect from 20 February 2021.

There is no underlying change to the arrangements currently in place whereby data held by Britannia is shared with and processed by the Managers (Tindall Riley & Co. Limited and Tindall Riley (Britannia) Limited) in accordance with formal legal agreements between Britannia and the Managers. With effect from 20 February 2021 Britannia Europe and Tindall Riley Europe Sàrl will become parties to these agreements.

Those Members affected by these regulations have been sent a ‘consent to waiver’ form and we would ask those Members to return the form to nellwood@tindallriley.com no later than 31 January 2021.
